This policy explains how personal information is collected and used in connection with the Term-Time Toolkit, its website, purchases, customer support and private community. It also explains the choices and rights available to you.
The Term-Time Toolkit is operated under MJMShiers Co, which acts as the data controller for the processing described here.
1. Scope of This Policy
This policy applies when you:
Visit the Term-Time Toolkit website or order pages.
Register your interest.
Download a free resource.
Purchase access.
Request admission to the Skool community.
Participate in community activities or live sessions.
Complete feedback.
Contact us or otherwise interact with the Term-Time Toolkit.
Third-party services such as Skool, Stripe, PayPal, Zoom and Tally also process information under their own privacy notices. Their services and websites are not controlled by this policy.
2. Information We May Collect
Depending on how you interact with us, we may collect:
Identity and contact information
Your name, email address, billing address and country.
Purchase and subscription information
The access option purchased, order date, amount paid, renewal status, transaction reference and payment status.
Payment providers process full card or account details; we do not normally receive or store complete payment credentials.
Account and community information
Your Skool profile name, profile image, admission request, posts, comments, messages, event participation and community moderation records.
Communications
Enquiries, support requests, complaints, survey responses and emails exchanged with us.
Marketing preferences
Whether you asked to receive updates and when you subscribed, unsubscribed or changed your preferences.
Technical and usage information
IP address, device and browser details, page visits, login or security information, referral source and cookie choices.
Optional feedback
Optional feedback about your experience of the resources. Feedback forms are designed not to require names or email addresses unless this is made clear at the point of collection.
Sensitive Information
Some feedback or communications may reveal information about physical or mental health, emotional wellbeing or other sensitive matters.
Please do not include identifiable information about pupils, families, colleagues or other people.
We do not require detailed medical information in order to provide the Toolkit.
Where we intentionally collect identifiable health information, we will explain why and identify an appropriate lawful basis and special-category condition, which may include your explicit consent.
3. How We Collect Information
We collect information directly from you when you complete a form, place an order, request access, join or use the community, attend a session, provide feedback or contact us.
We may also receive limited information from service providers, including Systeme.io, payment processors, Skool and email or analytics providers, where this is necessary to operate the Toolkit.
4. How and Why We Use Your Information
We use personal information only where we have a lawful basis.
The main purposes and bases are summarised below.
Providing Purchases and Access
We process orders, administer subscriptions, verify Skool admission and provide resources.
Lawful basis: Contract.
Customer and Community Support
We respond to queries, moderate the community, organise sessions and resolve technical issues.
Lawful basis: Contract and legitimate interests.
Legal and Financial Administration
We manage tax, accounting, refunds, complaints and establishing or defending legal claims.
Lawful basis: Legal obligation and legitimate interests.
Security and Service Improvement
We prevent misuse, protect accounts, diagnose faults and understand how services are used.
Lawful basis: Legitimate interests; consent where required for cookies.
Marketing and Updates
We send requested news, launches and relevant offers.
Lawful basis: Consent, or another basis permitted by electronic marketing law.
Feedback and Research
We assess the usefulness of resources and use feedback to improve them.
Lawful basis: Consent where identifiable sensitive information is requested; otherwise legitimate interests.
Where we rely on legitimate interests, those interests include operating and improving the Toolkit, supporting customers, maintaining security, preventing fraud and protecting our legal rights.
We consider whether those interests are proportionate and whether your rights override them.
5. Marketing Communications
We may send marketing emails where you have given consent or where another lawful electronic-marketing rule permits it.
Service messages about your purchase, access, renewal, security or changes to the Toolkit are not marketing and may be sent where necessary to administer your contract.
You can unsubscribe from marketing at any time using the link in an email or by contacting us.
Unsubscribing from marketing does not prevent essential service communications.
We may keep a minimal suppression record so that we can respect your request.
6. Who We Share Information With
We may share only the information reasonably necessary with:
Systeme.io and other website, funnel, order-form and email service providers.
Skool, which hosts the private community and course resources.
Payment providers such as Stripe and PayPal.
Tally or another provider used for optional forms and feedback.
Zoom or another provider used for online Q&A sessions, tapping circles or events.
Google Workspace and other communications, file-storage or administration providers.
Professional advisers, accountants, insurers and IT support providers.
Regulators, courts, law-enforcement bodies or other organisations where disclosure is required or permitted by law.
A buyer, successor or adviser if the business or Toolkit is reorganised, transferred or sold, subject to appropriate safeguards.
We do not sell personal information.
7. International Transfers
Some service providers may store or access information outside the United Kingdom.
Where UK data-protection law applies and a restricted transfer takes place, we will use a lawful transfer mechanism, such as UK adequacy regulations or appropriate contractual safeguards, and carry out any assessment required by law.
You may contact us for further information about the safeguards relevant to your information.
8. How Long We Keep Information
We keep personal information only for as long as it is reasonably needed for the purpose collected, including contractual, accounting, tax, legal, security and dispute-resolution requirements.
Our usual approach is:
Purchase, subscription and accounting records
Normally six years after the end of the relevant financial year or customer relationship, unless a different legal period applies.
Customer-support and complaint records
Normally up to six years where they may be relevant to contractual or legal claims; routine enquiries may be deleted earlier.
Community account and participation information
For the duration of access and for a reasonable period afterwards for administration, moderation, security and legal purposes.
Content posted within Skool may remain subject to Skool settings and retention processes.
Marketing records
Until you unsubscribe or we decide the information is no longer current, with a minimal suppression record retained to respect opt-out requests.
Anonymous feedback
May be retained indefinitely because it no longer identifies an individual.
Identifiable feedback is retained only as long as reasonably needed for evaluation and follow-up.
Cookie and technical information
According to the lifetimes stated in the Cookie Policy and the settings of relevant providers.
9. Security
We use reasonable organisational and technical measures to protect personal information, including access controls, secure service providers, account protections and limiting access to people who need it.
No online system can be guaranteed completely secure.
You are responsible for keeping your Skool and other account credentials confidential and for notifying us promptly if you suspect unauthorised access.
10. Your Rights
Depending on the circumstances and the law that applies, you may have rights to:
Ask for access to your personal information.
Ask for inaccurate or incomplete information to be corrected.
Ask for information to be erased.
Ask us to restrict how information is used.
Object to processing based on legitimate interests and object at any time to direct marketing.
Receive certain information in a portable format.
Withdraw consent at any time where processing is based on consent.
Complain to a data-protection regulator.
These rights are not absolute and may depend on the lawful basis and circumstances.
To make a request, contact pausereleasereclaim@mjmshiers.com.
We may need to verify your identity.
If you are in the UK, you may complain to the Information Commissioner's Office through:
If you live elsewhere, you may also have the right to contact your local data-protection authority.
11. Automated Decisions
We do not use personal information to make decisions with legal or similarly significant effects solely by automated means.
12. Children and Other People's Information
The Toolkit is intended for adults working in or connected with education and is not directed at children.
Do not post or submit names, images, case histories or other information that could identify pupils, family members, colleagues or other third parties.
If we become aware that unnecessary third-party information has been supplied, we may remove it and take appropriate steps.
13. Cookies
The website uses cookies and similar technologies.
Please read the separate Term-Time Toolkit Cookie Policy for information about the categories used and how to manage your choices.
14. Changes to This Policy
We may update this policy to reflect changes to the Toolkit, our service providers or the law.
The current version will be published with its effective date.
Where a change materially affects how we use existing information, we will take reasonable steps to bring it to your attention.
